Hotel partner terms

Welcome to LOVU Travel Inc. ("LOVU"). We are delighted to have you explore and use our advertising and marketing platform designed specifically for the travel industry. By accessing or interacting with our services, websites, mobile applications (“App”), or any associated content (collectively, "LOVU Services"), you agree to comply with these Terms of Use (“Terms”), as last updated on 01/02/2025. LOVU is a private service owned and operated by LOVU Travel Inc. If you are using LOVU on behalf of a business, you represent and warrant that you have the authority to accept these Terms on behalf of that business, which agrees to be bound by these Terms. If you do not agree to the Terms, you are not authorized to use LOVU Services. We reserve the right to modify these Terms at any time. You are responsible for checking periodically for changes and are bound by the Terms if you continue to use the LOVU Services following any updates.

Upon agreeing to these Terms and confirming that you are either of sufficient age and capacity or acting on behalf of a business entity bound by these Terms, LOVU grants you a limited, revocable, non-exclusive, non-assignable license to use LOVU Services, subject to these Terms. Unauthorized use is strictly prohibited. You agree not to reproduce, modify, create derivative works from, distribute, or sell any content from LOVU, excluding content you create and post. By posting content, you grant LOVU a perpetual, irrevocable, worldwide, fully paid, and sublicensable license to use, copy, distribute, and create derivative works from that content.

Unless expressly authorized through a separate written or electronic agreement, you agree not to use, provide, or develop software, services, or automation tools (e.g., robots, scripts, scrapers) that interact or interoperate with LOVU Services for purposes such as creating accounts, posting, flagging, or searching. Misuse of LOVU Services, such as through deceptive practices, solicitation, or engaging in prohibited content, is not permitted. You agree not to engage in activities that disrupt, abuse, or collect user information from LOVU Services without authorization.

LOVU may, in its sole discretion, moderate user access and use of its Services. This may include blocking, re-categorizing, filtering, or terminating access. You agree not to circumvent these moderation measures, and acknowledge that LOVU is not liable for moderation actions or omissions.

If you violate these Terms or support, encourage, or induce others to do so, you agree to be liable for liquidated damages as follows: (A) collecting or misusing user information - $500 per violation; (B) misrepresenting identity or affiliation - $1,000 per violation; (C) posting prohibited content - $100 per violation; and other enumerated violations and damages. The specified damages represent a reasonable estimate of potential harm to LOVU and do not limit any other available remedies.

By setting up an account for our fee-based services, you authorize LOVU to charge your provided payment method for the associated fees, plus any applicable taxes. Payments are non-refundable, even if content is moderated, delayed, or removed.

Platform leads are delivered as an alert to the registered email address and can be accessed through your LOVU dashboard. You will receive detailed information about the traveler's requirements and you can chat with travelers within the LOVU dashboard. Properties agree to respond to all booking inquiries within twenty-four (24) hours of receipt. Failure to do so will result in the inquiry expiring and being automatically rerouted to travel advisors for response.

LOVU Services are provided "as is" and "as available." LOVU, including its officers, directors, employees, and affiliates, disclaims any warranties of completeness, accuracy, merchantability, fitness for a particular purpose, or non-infringement. You assume any risks associated with the use of LOVU Services. To the fullest extent allowed by law, LOVU is not liable for direct, indirect, incidental, or consequential damages resulting from the use of LOVU Services. Liability, if any, is limited to $100 or the amount you paid in the prior year.

Any claim, cause of action, or dispute related to LOVU Services shall be governed by New York law, without regard to conflict of laws. Claims must be resolved exclusively by courts located in New York, NY. You agree to indemnify and hold LOVU harmless from any claims or expenses, including attorney fees, arising from your use of LOVU Services.

LOVU Travel and related marks are protected trademarks of LOVU Travel Inc. You agree not to use or exploit LOVU trademarks or proprietary content without explicit authorization.

This agreement, unless supplemented by additional terms or agreements with LOVU, constitutes the entire agreement between you and LOVU. No waiver or modification of these Terms by LOVU shall occur without written consent. If any part of these Terms is deemed unenforceable, the remainder will continue in effect to the fullest extent permitted.
